What is a Notary Public?
A Notary Public is a Public Officer, appointed in Ireland by the Chief Justice. The function of a Notary Public includes authenticating public and private documents; attesting and verifying signatures to documents in order to satisfy evidential or statutory requirements of foreign governments, of overseas institutions and regulatory authorities, protesting bills of exchange and promissory notes for non acceptance or non payments; drawing up ships protests, giving certificate as to the acts and instruments of persons and their identities. A Notary is empowered to administer oaths and take affidavits. He/She may draw up documents of a legal nature, take evidence as a Commissioner for foreign courts and also verify translations from foreign language into the vernacular and vice versa. The Notary's official acts are executed under his official seal and signature. His/Her signature on certain documents, alone on certain documents may suffice.

What documents are required to be notarised?
1. Powers of Attorney for the purchase, sale or otherwise of foreign property.
2. Application papers for adoption of children abroad.
3. Affidavit for use in foreign courts.
4. Documents from institutions of this State for use abroad.
5. Dishonoured international bills of exchange which need to be noted or protested.
6. Several types of international contracts and commercial agreements.
      
Legalisation.
After a document has been notarised, it is then normally legally acceptable in that the certification requirements of international law have been complied with. However, there are countries which are not party to the Hague Convention on the use of the Apostille, that require additional authentication or legalisation.
If your document is bound for those particular countries, you will need to bring your notarised document to the Supreme Court Office in the Four Courts Dublin, who will issue a certificate. The certified notarised document must then be brought to the Department of Foreign Affairs who verify the status of the Supreme Court. You are then required to bring the notarised, certified and verified document to the Embassy or Consulate representing the particular country where the document is bound for.
      
Apostille.
The Apostille is an official certificate in lieu of legalisation to vouch the due execution of a public document given by a competent authority of a subscribing country to the Hague Convention on the abolition of legalisation. You will need to attend at or post the document to the Apostille section of the Department of Foreign Affairs, Consular Services Section, Hainault House, 69/71 St. Stephens Green, Dublin 2, where upon by post or personal attendance and on payment of the prescribed fee, the Department will endorse the Apostille Certificate upon the particular document.
